Many private foundations and public charities have programs for making grants to individuals.  The purpose can range from recognizing or enabling human achievement (such as through award programs or scholarships and fellowships) to disaster or poverty relief.  There are a number of legal rules and pitfalls to be mindful of in structuring individual grant programs in order to ensure that the objective of the program is achieved.

  • The tax law and regulatory requirements for individual grant programs
  • The special rules for private foundation grants to individuals for travel, study, or other similar purposes, including obtaining IRS approval
  • How to structure individual grant programs that are administered by public charities
  • Other special scenarios, including disaster relief, dealing with intellectual property issues, and making grants to individuals from donor-advised funds
